Air Emission Litigation Support
Solution
Aries modeled emissions from the incinerator stack to assess whether the relative downwind pollutant concentrations and particle deposition rates were consistent with reported observations of odor and particle deposition on the abutting property. The relative downwind pollutant concentrations predicted by the model were consistent with documented odor complaints, and the relative particle deposition rates predicted by the model were consistent with documented excess visible emissions from the stack.
We assessed modeled emission impacts using alternate stack heights to reduce atmospheric downwash effects of nearby structures. The model results predicted relative decreases in site downwind pollutant and site particle deposition rates as stack height increased.
Aries’ expert opinion report assisted legal counsel to negotiate a favorable settlement
Problem Nature and Extent
Property owners and visitors to a commercial establishment abutting an incinerator complained of noxious odors and substantial emissions from the incinerator stack. Aries was retained to prepare an expert opinion report assessing emission impacts and stack modifications to decrease downwind pollutant concentrations and particle deposition rates from the incinerator.
